2024 POLARIS SNOW- RIDE INTO WINTER ON US SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. SWEEPSTAKES DATES: The “2024 Polaris Snow- Ride Into Winter on Us” Sweepstakes (the “Sweepstakes”) begins on December 1, 2024 and ends on December 31, 2024 (the “Sweepstakes Period.)
2. ELIGIBILITY: The Sweepstakes is open to: i) legal permanent residents of the fifty (50) United States and the District of Columbia (excluding residents of Florida) who are eighteen (18) years of age or older or the age of majority in his/her state of residence, or ii) a legal resident of Canada and at least the age of majority in their province or territory of residence at the time of entry (the “entrant”). Persons in any of the following categories are not eligible to participate or win a prize: (a) persons who, since December 1, 2024 were or are employees, officers, directors or agents of Polaris Industries, Inc. (the “”Sponsor”) or National Sweepstakes Company, LLC (the “Independent Administrator”); their parent companies, affiliates, subsidiaries, or dealers; or the service agencies of any of the above organizations; (b) individuals engaged in the development of, the production or distribution of materials for, or the implementation of this Sweepstakes (collectively “Released Parties”); or (c) employees of, persons in the immediate family of, or persons living in the same household as any person in any of the preceding categories. For the purpose of this Sweepstakes, “immediate family members” are defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children, and grandchildren. Void in Florida and outside the fifty (50) United States, Canada and where prohibited or restricted by law. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
Any Sweepstakes entries received from an ineligible participant will be disqualified. By participating in this Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the Official Rules of the Sweepstakes in any way at any time, subject to state or federal law.
3. HOW TO ENTER. There are two (2) ways to enter:
A. VIA A PURCHASE: Visit a Polaris dealership and make a qualifying purchase of any new 2022- 2025 Polaris sled or 2025 SnowCheck pick-up to receive one (1) entry into the Sweepstakes. Entrant will need to provide all of the required information as requested in order to submit and complete a purchase. Upon completion of the purchase, Entrant will automatically receive the entry. Entrant may receive one (1) entry for each qualifying purchase during the Sweepstakes Period.
B. ALTERNATE METHOD OF ENTRY (“AMOE”): To receive an entry into the Sweepstakes without making a purchase, Entrant must enter as follows: on a plain 4” x 6” postcard, legibly handprint in black ink your first name, last name, email address, and telephone number and send in a #10 envelope to: “2024 Polaris Snow- Ride Into Winter on Us” PO Box 428, Newark, NY 14513. Entries must be postmarked December 31, 2024 and received by January 9, 2025. Each postcard is considered one (1) entry into the Sweepstakes. Entries submitted or completed by anyone other than the Entrant are void. No mechanical reproductions will be accepted. All entries submitted become the sole property of Sponsor and will not be returned. Sweepstakes Entities are not responsible for lost, late, misdirected, illegible, postage due or damaged mailed entries.
There is a limit of five (5) entries per entrant for the Sweepstakes. Entrant may enter the Sweepstakes under one name and one email address only. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different identities, and/or any other methods will void that Entrant’s entry and that Entrant may be disqualified from the Sweepstakes.
In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name and mailing address were submitted via the entry form (the “Authorized Account Holder”). A potential prize winner may be required to show proof of being the Authorized Account Holder. If the Sponsor cannot determine the identity of the person based upon the information submitted via the entry form, the respective entrant will be disqualified. Sponsor will not verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned.
Neither Sponsor nor Independent Administrator is responsible for any entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.
Without limitation, Sponsor reserves the right in their sole discretion to disqualify any entrant whose social media account that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Sweepstakes or any other person or entity; does not comply with these Official Rules; or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein.
4. DRAWING/ODDS: On or about January 13, 2025, five (5) prize winners will be selected at random from among all eligible entries received during the Sweepstakes Period. Odds of being selected as a prize winner are based upon the total number of eligible entries received during the Sweepstakes Period. The random drawing and determination of the prize winners will be conducted by the Independent Administrator whose decisions are based upon their sole discretion of these Official Rules and are final and binding in all respects.
5. PRIZE: Each prize winner will receive a payoff of their statement balance up to $24,099USD/$29,539CAD for the prize winner’s purchased 2022 to 2025 Polaris sled or 2025 SnowCheck pick-up during the Sweepstakes Period. The statement balance excludes any PG&A added. No more than the statement balance will be paid on behalf of the prize winner up to a maximum amount of $17,346USD/$19,952CAD. Total approximate retail value (“ARV”) of each prize is $24,099USD/$29,539CAD. If the prize winner does not have a statement balance and entered via the write-in entry method, the prize of $17,000USD/$20,000CAD cash will be awarded to the prize winner in the form of a check.
Total ARV of all prizes to be awarded is $120,495USD/$147,695CAD.
PRIZE RESTRICTIONS: Limit of one (1) prize per entrant/household. Sponsor will determine all details of a prize in their sole discretion. No prize substitution, except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if a prize becomes unavailable due to reasons beyond the control of the Sponsor; provided no such substitute prize shall be from Sponsor without its prior written consent. Prizes are not transferable prior to award. No more than the number of prizes set forth in these Official Rules will be awarded.
6. PRIZE NOTIFICATION/CLAIM: Prize winner will be notified by the Independent Administrator via email following the random drawing (the “Notification”). Prize winner must respond to the Notification within the date and time specified in order to claim the prize by completing an Affidavit of Eligibility/Liability/Publicity Release Form and an IRS Form (the “Required Documents”). If the prize winner is a legal resident of Canada (excluding Quebec), they will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing questions.
Sponsor reserves the right, in its sole discretion, to disqualify and randomly select an alternative potential prize winner if: (a) the potential prize winner does not respond within the Notification timeframe; (b) the Required Documents are not returned or completed; (c) the Notification is returned as undeliverable; (d) the potential prize winner declines acceptance of the prize; (e) potential prize winner who is a resident of Canada does not answer the required skill question correctly and within the time allotted, and (f) if in Sponsor’s determination, the potential prize winner has not complied with these Official Rules.
The prize is taxable as income and the prize winner is solely responsible for any taxes on the prize, including, but not limited to all applicable federal, state and local taxes. A third Party must report the value of the prize to the IRS in the year the prize is received by the prize winner and will be reported to the prize winner and the IRS in the form of a Form 1099 or Form 1042-S. If it is determined by the Sponsor, in its sole discretion, that the potential prize winner is not eligible in accordance with these Official Rules, the potential prize winner forfeits their right to the prize and an alternate will be selected as outlined above. In the event that the potential prize winner is disqualified for any reason, Sponsor shall have no liability or obligation to such individual.
7. PUBLICITY. By accepting a prize, where permitted by law, prize winner grants to Sponsor, and those acting pursuant to the authority of Sponsor, the right to print, publish, broadcast and use—worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web—at any time(s), that prize winner’s name, portrait, picture, voice, likeness (as is or as may be edited, altered, or cropped), information, and biographical information as news or information and for advertising, trade, and promotional purposes without additional compensation or review.
8. RELEASE OF LIABILITY AND AGREEMENT TO HOLD HARMLESS. By participating in this Sweepstakes, all entrants, and prize winners agree to release and hold harmless Sponsor and its parent and subsidiary companies, affiliates, subsidiaries, officers, directors, agents, and employees; and all others associated with the development and execution of this Sweepstakes (the “Released Parties”) (and agree to confirm this release and agreement to hold harmless in writing(s)) from any and all alleged and/or actual actions, demands, losses, settlements (whether or not litigation is commenced), claims, damages, liability, and costs whatsoever (including attorney fees), existing now or in the future, with respect to or in any way arising from this Sweepstakes or participation in any sweepstakes-related activity, redeeming prizes, and/or delivery/mis-delivery, acceptance, possession, use, or misuse of a prize including, but not limited to, liability for personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind.
The Released Parties are not responsible for: (a); unauthorized human intervention in any part of the entry process or the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c) any property loss, damage, personal injury or death, in connection with the prizes provided pursuant to this Sweepstakes and/or any person’s participating in the Sweepstakes (d) any printing or typographical errors in any Sweepstakes-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries or the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet Service (as applicable); and (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (including Entrant’s particular wireless device carrier network, if applicable), hardware or software.
9. GENERAL CONDITIONS: Only the stated number of prizes set forth in these Official Rules will be awarded. Should any portion of the Sweepstakes be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupts or impairs the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted at the Polaris locations. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
10. DISPUTES. THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE STATE OF NEW YORK WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York, having jurisdiction over the parties and the subject matter. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
11. USE OF DATA. By entering this Sweepstakes, each entrant expressly consents to the storing, sharing, and use of the personal information submitted with his/her entry by Sponsor and its agents and/or representatives, only for the purpose of administering the sweepstakes and in accordance with Sponsor’s Privacy Policy, unless entrant otherwise agrees. All entry and other information submitted may be used for advertising, trade, and marketing purposes both by Sponsor and authorized third parties in accordance with Sponsor’s privacy policy, available at https://www.polaris.com/en-us/privacy/
12. RULES/WINNER’S LIST: For the name of the prize winners, please submit a self-addressed, stamped envelope by February 13, 2025 to “2024 Polaris Snow- Ride Into Winter on Us” Sweepstakes”, PO Box 458, Newark, NY 14513.
